Hole in WON Club – Terms of Use

Welcome to Hole in WON Club (“we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern both your use of our website and your participation in our contests. By accessing our website or registering for a contest, you agree to these Terms. If you do not agree, you should not use this Site or enter a contest.

Part A – Website & General Use

1. Use of Website

The Site is provided for informational and promotional purposes only.

You must be at least 18 years of age (or the age of majority in your jurisdiction) to use this Site.

You agree not to misuse the Site for any unlawful purpose.

2. Intellectual Property

All content, trademarks, logos, graphics, and media on the Site are the property of Hole in WON Club or its licensors.

You may not copy, reproduce, or distribute any material from the Site without prior written consent.

3. Accuracy of Information

While we aim to ensure accuracy, we do not guarantee all information is current, complete, or error-free.

We may update or modify content at any time without notice.

4. Links to Third Parties

The Site may contain links to third-party websites. These are provided for convenience only.

We are not responsible for the content, practices, or services of third-party websites.

5. Privacy

Part B – Contest Participation

6. Eligibility

Open to golfers aged 18+ playing a round at participating clubs.

Only one (1) contest attempt per player per round.

Club staff and Hole in WON employees are not eligible.

7. Participation

Players must scan the official Hole in WON QR code and pay the participation fee before teeing off on the designated hole.

Entrants must provide their full name and contact details.

8. Contest Rules

Eligible shots must be played from the designated tee markers during normal play.

Only the first stroke counts (no mulligans, retries, or practice balls).

The contest applies only to the designated contest hole.

9. Verification

All attempts are recorded by Hole in WON solar-powered 4K cameras (tee and green).

A hole-in-one is valid only if the ball is captured on video entering and resting in the hole.

Hole in WON will review and confirm results within 72 hours.

10. Prizes

All prizes are fully insured/self-insured by Hole in WON Club.

Prize values are capped and guaranteed.

Verified winners will receive their prize via EFT within 14 business days of confirmation.

Winners consent to Hole in WON using their name and footage for promotional purposes.

11. Refund Policy

Participation fees are non-refundable except in the event of processing errors.

12. Fair Play & Integrity

Any tampering, false play, or interference with the camera system will result in disqualification and possible legal action.

Clubs must not interfere with Hole in WON equipment.

Part C – Legal

13. Limitation of Liability

The Site and contests are provided “as is” without warranties of any kind.

Hole in WON accepts no liability for:

Weather interruptions

Connectivity or power failures

Any losses beyond the participation fee

Nothing in these Terms affects your rights under Australian Consumer Law.

14. Disputes

Disputes will be reviewed by Hole in WON in good faith using official video evidence.

All decisions are final.

15. Governing Law

These Terms are governed by the laws of Queensland, Australia.

Participants agree to the exclusive jurisdiction of Queensland courts.

16. Changes to Terms

We may update these Terms from time to time.

Continued use of the Site or participation in contests after changes are posted constitutes acceptance of the updated Terms.
